Terms of service
Last updated: [date you publish this]
These terms apply when a business ("you") uses ScripDock. By creating an account or a company, you agree to them.
1. Who we are
ScripDock is offered by [your full name], a sole proprietor trading as ScripDock ("we"), of [physical address], South Africa. Email: [email protected]. Our privacy policy explains how we handle personal information.
2. The service
ScripDock is an online tool for shift rosters, clocking in and out, staff records, written warnings, leave and contracts. We may improve or change features over time; we will not remove a core feature you pay for without telling you first.
3. Accounts
- The person who creates a company is its owner and is responsible for it, including who they let in and which role each person gets.
- Keep passwords private. You are responsible for what is done with your company's accounts.
- You must be allowed to act for the business you sign up.
4. Free trial
Each new company gets a free trial of 30 days, with no card needed. Each person gets one free trial: a company created later by the same person or email address carries on from the first trial's dates.
5. Plans and payment
- The monthly price depends on the most staff a company had active during the month: Starter (up to 15) R249, Team (up to 40) R449, Business (up to 100) R799. Larger companies get a quote. [State whether prices include VAT once you know.]
- Subscriptions are paid monthly in advance by card through our payment provider, once online payment is offered.
- If your team grows into a larger plan, the new price applies from the next billing date.
- We will give at least 30 days' notice of any price change.
6. Missed payments and cancelling
- If a payment fails, you have 7 days to fix it. After that the company becomes read-only: you can still see and export everything, but not make changes, until payment is made.
- You can cancel at any time. You keep full use until the end of the month you paid for. We do not refund part months, except where the law gives you that right.
- We do not delete a company's records because of a missed payment without warning the owner first.
7. Your data
- The records you put into ScripDock remain yours. You can export them to Excel at any time, and the owner can delete the company and everything in it.
- You are responsible for collecting and using your staff's personal information lawfully, including under POPIA, and for telling your staff that you keep their records in ScripDock.
8. HR decisions are yours
ScripDock helps you keep records, such as numbering warnings and reminding you of hearings. It does not give legal advice. You remain responsible for fair labour practice and for following the Labour Relations Act, the Basic Conditions of Employment Act and your own policies.
9. Fair use
Do not use ScripDock to break the law, to store content you have no right to store, to try to reach another company's data, or to disrupt the service. We may suspend an account that does.
10. Availability and liability
- We work to keep ScripDock running and your data safe, but we cannot promise it will always be available or free of errors.
- As far as the law allows, we are not liable for indirect or consequential losses, and our total liability is limited to what you paid us in the three months before the claim.
- Nothing in these terms takes away rights you have under the Consumer Protection Act or the Electronic Communications and Transactions Act where those apply to you.
11. Changes and law
We may update these terms; for important changes we will tell owners at least 30 days ahead. South African law applies. Questions: [email protected].
